Terms and Conditions for talkrugs

Introduction

Any purchase of goods using this website is governed by these terms and conditions and our privacy policy. Before you confirm your order, please read through them both.

By using this Website, you agree to accept all terms and conditions written in here. Please do not use this Website if you disagree with any of these Website Standard Terms and Conditions.

This website is owned and operated by TALKRUGS Ltd, a trademark limited company registered in England and Wales under company number 13019230, with our registered office address at 76 Manchester Road, Denton, Manchester, M34 3PS.

Making a Purchase with us

Browse our online goods, which includes the description, size, and current price of the goods.

Once you choose the size and quantity of the item you want to purchase, select ‘Add to Cart’. You can choose whether to go to your Cart or continue browsing goods.

Your total bill will be listed and calculated in your Cart before you visit the Checkout. You can add your discount code here and edit the contents of your Cart.

When you have finished browsing, continue with your purchase using our secure online purchasing facility. Click on the Secure or Guest Checkout.

You will be asked to provide information to enable us to process your order such as your delivery address and payment details. It is your responsibility to provide us with sufficient information to process your order.

Our secure server provider will process the payment for VISA, Mastercard or Maestro or through PayPal to complete your order.

Accepting your Order

When we receive your order, we will acknowledge its receipt by email. This is not our acceptance of your order, but confirmation that we have received the order.

Only if and when you receive an email to confirm the acceptance of your order, will there be a binding contract between us.

We kindly ask you take the time to check the details of your order are correct.

Order Agreement

All customers will be asked at the checkout to confirm they have read these terms and conditions of trading with talkrugs.co.uk.

The contract between us as buyer and seller will consist of these terms and conditions, together with our privacy policy, your order, and our acceptance of the order.

Product Lead Times

The estimated lead times for our goods can vary considerably. You can see the estimated lead times on our product pages and within the details of your order on your account. While we do our very best to honour the lead times we give you, the timescales are estimates only and are not contractual.

In the case of goods being out of stock or subject to lengthy delays, we will contact you about your order as soon as possible.


Order Eligibility

You must be 18 years of age or over and able to provide full details of a delivery address to purchase goods from this website.


Prices

The prices payable for goods on our website are set out in Pound Sterling and include any applicable VAT.

Unless otherwise stated, only one promotion or discount code can be used per order.


Product Representation

We make every effort to accurately reproduce the appearance of the rugs we stock and cannot accept responsibility for any colour misrepresentations. The appearance of the colours in rug images can be impacted by the colour display settings on individual computer monitors. If you are unsure about any of our rugs, we recommend you contact us before committing to a purchase.

While you can return rugs to us that look different upon delivery, the rugs will not be deemed faulty, and you will be responsible for the return costs.


Sizes

The sizes of our rugs are quoted as a representation only. Slight variations in size are unavoidable with handmade rugs. By their very nature, natural fibres can shrink in different environmental conditions, which is why we state handmade, and machine made rug sizes may vary by up to +/-5%.  


Rug Shedding

It is important to note that slight pile shedding is inevitable with rugs, especially in those made from wool or acrylic. 
We will not consider these goods to be faulty, moreover shedding is a feature.


General

We reserve the right to change any of the products, product prices, product descriptions and availability at any time.

All prices and descriptions supersede all previous publications, and all product descriptions are approximate.


Cancellations & Returns

Bespoke and made to measure rugs are non-returnable and cannot be cancelled once the order has been confirmed.

If you are unhappy with your purchase, you can return goods to us within 14 days of receipt for a refund or exchange. You are responsible for returning the goods, securely packaged, in their original condition.

We highly recommend you inspect your goods thoroughly on delivery in respect of colour, design, condition, quality, and quantity.

Our right to cancel

We many cancel your order and the contract between us, in the event of the following:

1.    The goods you have ordered are no longer available or have been discontinued. 
2.    We are unable to deliver to your address. 
3.    One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information provided to us by our suppliers.

If we need to cancel your order, we will notify you by e-mail and provide you with a full refund. While we can endeavour to find alternatives, we cannot offer additional compensation for any inconvenience caused.


Delivery of Goods

We will deliver the goods ordered by you to the address you provide at the time you make you order.

If your delivery details change, please inform us as soon as possible by email. Once your order has dispatched, we cannot change the delivery details or accept cancellation of the order.

We will inform you by email once your order has been dispatched. Please ensure someone will be available to receive your order at the address given.

Deliveries usually take 5-10 working days. In the event of a stock issue and the need to wait longer, we will contact you by email.

Once the goods you ordered have been delivered to you, you will become the owner of them. The goods will be held at your own risk, and we will not be liable for their loss or destruction.

If you arrange for the goods you ordered to be left in a secure location upon delivery, please be aware that we will not accept responsibility for damaged or missing orders.

You can return delivered goods to us in line with our 14-day return policy.


Failed Deliveries

Should it happen that the delivery of your goods fails and orders are returned to us, we reserve the right to charge a re-delivery fee. An administrative fee will be charged for failed deliveries for which a refund is requested.


Collection of Goods

As outlined in our Delivery & Returns information, you are able to collect the goods you have ordered from us, from one of two of our flooring showrooms.

If you will be collecting your goods, you can select Collection at the time of making your purchase.

Once you collect the goods from us, you will be the owner of the goods. They will be held and transported at your own risk, and we will not be liable for their loss or destruction.

Please note we cannot hold goods for longer than 72 hours.


Incorrect Goods

In the unlikely event you receive the incorrect goods with your order, we ask you notify us within 48 hours of receipt by email to sales@talkrugs.co.uk.

To help us rectify the issue as quickly as possible, we will ask you to provide us with a picture of the rug and its label.

Faulty Goods

As outlined in our Delivery and Returns information, in the case of faulty items, we ask you to email us as soon as possible with your order number, the name of the faulty rug and good quality photos to show the faults.

We reserve the right to arrange for goods to be collected and inspected.


Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.


Privacy

You acknowledge and agree to be bound by the terms of our privacy policy, which you can read in full here.


Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.


Third Party Rights

A person who is not a party to this contract has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.


Governing Law

The contract between us and these terms and conditions are governed by and interpreted in accordance with the laws of English and Wales.

talkrugs is a registered trademark.

We do not grant you any right to use the talkrugs registered name, logo, or symbol without our prior approval.
